How the free review works
- You send the HOA name. Five fields and one question. If you have the declaration, covenants, fee notice, or rental policy, great—we’ll ask for them when we call. If you don’t, submit the HOA name anyway.
- We find and read the governing documents. The recorded declaration and its amendments first, then the bylaws and the rule or policy that created the fee.
- We compare the fee to the authority. Does the declaration restrict rentals or authorize rental charges? Was the fee adopted the way the documents require? Where does the money go?
- We tell you what we found. Sometimes the answer is that the fee is likely authorized. When we believe there is a claim worth pursuing and the firm accepts the matter, you sign a written engagement agreement first.
What it costs
The review is free. In contingency matters the firm accepts, there is no attorney’s fee unless you win. Who pays court costs and litigation expenses is spelled out in the written engagement agreement before anything is filed.
Class actions
We pursue appropriate HOA fee cases on behalf of groups of owners who were charged the same fee. A court decides whether a case can proceed as a class action; that is never guaranteed.
